EABL Addresses Bia Tosha Lawsuit, Terms Allegations Unfounded

East African Breweries Limited (EABL) has clarified that a court case filed by Bia Tosha is unrelated to the recent Diageo-Asahi transaction.

In a statement released on January 7, 2026, EABL said the matter involves a long-standing dispute over distribution territories in Kenya and is part of an ongoing legal campaign by a former employee and distributor. “All claims made are devoid of truth,” the company noted.

“We wish to clarify that the matters in court relate to a long-standing dispute between Bia Tosha and KBL regarding distribution territories in Kenya and have absolutely no factual or legal linkage to the announcement of the Diageo-Asahi transaction,”EABL said in a statement.EABL AND Bia Tosha   

EABL emphasized that despite the change in majority shareholder, both EABL and Kenya Breweries Limited (KBL) remain independent and fully capable of managing their operations and defending any litigation.

“Regardless of the change of majority shareholder, EABL and KBL remain independent, capable entities fully able to conduct their business and defend any litigation. Any insinuation to the contrary is false and inimical to the interests of Kenya as a nation that attracts high-quality foreign investment, “Statement added.

The company added that any suggestion linking the court case to the transaction is false and could harm Kenya’s reputation as a destination for high-quality foreign investment.

The statement described the lawsuit as the latest in a 10-year effort by what it called a “serial litigant” to destabilize its business operations.

“This application is merely the latest iteration of an unsuccessful 10-year campaign by a former employee and former distributor—now a serial litigant—to destabilize and damage EABL’s business operations. All claims made are devoid of truth,” statement read.
